On Wednesday, the Ninth U.S. Circuit Court of Appeals ruled that states can deny food stamps to legal immigrants.  The ruling reverses a lower court decision which blocked Washington state from removing non-citizens from the state’s food stamp assistance program.

In February 2011, Washington Gov. Christine Gregoire ordered that 14,350 legal immigrants in her cash-strapped state stop receiving food stamps.  However, the U.S. District Court for the Western District of Washington quickly blocked her move, stating it was likely an unconstitutional act of discrimination based on citizenship status.

The appeals court ruling stated:  States constitutionally can do precisely what Washington did here:  "...provide supplemental benefits when the state's coffers bulge, but eliminate them when the state's resources diminish.”

In 1996, a law was passed denying food stamps to legal immigrants who had not yet become citizens.  Then, in 2003, another law was passed making immigrant minors eligible for food stamp assistance.

According to John Camp with the Washington state Department of Social and Health Services, removing the more than 14,000 non-citizens from the food stamp program will save the state more than $60 million over the next two years.

The Democrats always howl with protest any time the matter of fraud in elections comes up.  When their candidate has lost by a slim enough margin that the election is open to recount manipulation, they loudly proclaim that the election was "stolen" from their candidate.  But otherwise, they insist there is no such thing as voter fraud.  This is the mantra of the left and of their primary media shills, such as the New York Times.

In hearing after hearing in Raleigh, I have had to endure the indignant objections and lies of the left who bitterly opposed North Carolina's Voter ID bill.  Now the Voter ID law is not a silver bullet -- it won't stop all forms and strategies of voter and election fraud, but it's a great step forward in returning integrity to our elections process.

And we always hear how illegal immigrants are not voting.  Really?  Well, there hasn't been extensive proof of this -- again according to the Democrat Party and the left.  Well, might that be because of the difficulty in tracking it all down, the resistance of the state boards of elections to open their records to scrutiny, the intransigence of those same boards to admit holes and flaws in their procedures, and the efforts made on the part of the defrauders to hide their crimes?

The following video highlights an investigation by a principled news team in Florida which sampled voter registrations against jury summons records to find 100 fraudulent illegal immigrant voters.  No such fraud, huh?  It's only a Republican right-wing myth to disenfranchise poor voters, huh?  Give me a break already.   Enough with the lies.

The problem that I have with the Florida Board of Elections' response to the exposé is that these two offices will begin to get copies of jury summons to find illegal immigrants who self-identify themselves on those summons.  First, if the illegal immigrant illegally serves as a trial jurist and does not admit he/she is illegal, then the illegal immigrant still goes undetected and continues to vote illegally.  Second, there are much, much easier ways to verify whether the name and identification on a voter registration form is a U.S. citizen.  Using jury summons is a convoluted backdoor and haphazard means to prevent this form of fraud.

It was a great idea for the news team to prove conclusively that Florida (and all other states) have a real problem.  But it shows how small minded the bureaucrats actually are that they cannot think of any other way to approach this crime.  What a shame!  What a travesty!  What a crime!

A local Florida station invented an unprecedented way to check for voter fraud: jury excusal forms.  NBC2 compiled a list of jury excusals based on not being a citizen of the United States and compared it to a list of registered voters in two counties.  They discovered almost 100 illegally registered voters, many of whom had voted multiple times.  "I vote every year," one woman told NBC2, despite the fact that she is not a US citizen.  The woman had told the court that she couldn't serve on a jury because she wasn't a US citizen, but she doesn't seem to have a problem voting like one.

Based on the NBC2 investigation, local election offices say they'll now request a copy of every jury excusal form where residents say they can't serve because they're not a citizen.

I don't claim to be a Constitutional legal "expert".  But, then again, the Constitution was not written by our Founding Fathers to be obtuse.  It was not written to be readable only by an elite group of intellectuals or government licensed lawyers, appointed judges, or self-proclaimed intellectually-superior university professors.

No, the Constitution is written in plain English.  Now, to be true to the intent, one has to use the traditional dictionary definitions of words as they were used at the time the Constitution and each of its Amendments were written.  That is where the progressives fail.  Progressives want to change the meanings of words.  They want to publish a new dictionary every year with new meanings and definitions.  That just won't fly when we're dealing with the foundational law of our nation.

So let's take a moment to read Article 3, Section 2, Paragraph 2 of the U.S. Constitution:

"In all cases affecting Ambassadors, other Public Ministers and Consuls, and those in which a State shall be Party, the Supreme Court shall have Original Jurisdiction.   In all the other cases before mentioned, the Supreme Court shall have appellate Jurisdiction. both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make."

Now when the attacks and lawsuit against Arizona first hit the news, I happened to be attending a Constitutional seminar sponsored by the John Locke Foundation, AFP, and our local tea party group.  I raised the question, quoting the above paragraph, how the Federal Government could bring suit in a Federal Court against the State of Arizona?  I also asked why all the media was reporting that the case might work its way through the appeals process to the Supreme Court?  I asserted that my reading of this paragraph of Article 3, Section 2 told me that the case should have been brought before the Supreme Court initially and that only the Supreme Court has jurisdiction.

I didn't get a good answer.  I continued to wonder month after month as I read the news.  I wish I had pursued my convictions, although I'm still not certain with whom I could realistically pursue them.  Who would listen to little old me?  What do I know?  Hmmm....  It seems like I might know more than I'm often given credit for knowing!

This article in The Examiner tells how a real, bona-fide, licensed, and certified Constitutional lawyer is now causing an uproar and a Constitutional crisis by pointing out that the Ninth Circuit Court of Appeals has no legal authority to hear the case.  Turns out that none of the high-paid government lawyers in either the Department of Justice, Arizona, the original Federal judge, or anyone else for that matter, ever bothered to read the Constitution!  These people take solemn oaths to uphold and defend the Constitution of the United States, and the assholes never even bother to read it!  You can't make this stuff up!

I feel somewhat smarter.  I wish I had the readership and influence of the legal lawyers and the bigger media outlets.  But then, it's just little old me here.  What do I know?

_The Obama administration has reversed the nation’s illegal immigration policy.  On December 29, US Immigration and Customs Enforcement (ICE) announced new measures in dealing with illegal immigrants.  Instead of accepting custody of illegal aliens for deportation, ICE will now only accept illegal immigrants who have been arrested, tried and convicted of a separate criminal offense.  In short, illegal immigration is no longer considered a crime by the Federal government.

A separate section of the ICE bulletin announcing the policy change also contains information regarding the new toll free phone number ICE has set up to aid individuals arrested and facing possible deportation.  If the ICE announcement can be taken at its word, it states, “The new measures include a new detainer form and the launch of a toll-free hotline - (855) 448-6903 - that detained individuals can call if they believe they may be US citizens or victims of a crime.”

The part of the announcement that has shocked many on both sides of the immigration policy debate is the section that reads:  “The new form allows ICE to make the detainer operative only upon the individual's conviction of the offense for which he or she was arrested.”

In other words, ICE will only deport illegal immigrants if they are convicted of something other than illegal immigration.

Under current law and its previous interpretation, local authorities are allowed to detain illegal immigrants for up to 48 hours longer than they normally would be allowed to, but only if Federal authorities submit an official ‘detainer’ request.  Now, ICE will only submit the request for individuals tried and convicted of separate crimes.

“Lots of criminal aliens will be released if the locals don’t have the resources or inclination to prosecute, or if the [suspect] is found not guilty because of a technicality,” Mark Krikorian, director of the Center for Immigration Studies, told The Daily Caller this weekend.  “We’ll have more and more instances of illegals released by police because [federal immigration officials] wouldn’t take them, who then go on to commit some heinous crime,” he added.

The new policy also requires local authorities to provide all detainees with a copy of their rights, in the form of the detainer form, including the fact that they can’t be held more than 48 hours.  If they are held longer than that, or if their “civil rights or civil liberties” are violated, the suspected illegal immigrant is required to be informed of how to make an official complaint.  To insure detainees understand their rights, the detainer form will be printed in Spanish, French, Portuguese, Chinese and Vietnamese.

_Late Friday Obama announced a small change in federal immigration regulations. It sounds innocuous, but it will allow illegals to get "green cards" while In the US without suffering a penalty.  Normally illegals have to get green cards outside the US and suffer a penalty of being refused re-entry for 5 years for coming illegally in the first place.

This will make green cards available to "hundred of thousands" of illegal aliens according to the NY Times.

And remember, illegal aliens do not care about citizenship.  They want "residency".   It gives them the right to work and take American jobs.

The real "news" does not come during regular hours.  Sleazy government tricks are reserved for late on Fridays.

What this corrupt and destructive Administration is doing is unbelievable.  Why the American People are taking this in so relatively mild and submissive manner, I cannot understand.  The Department of Justice under the completely unprincipled tool, Eric Holder, has completely turned the concept of Justice upside down.Of course this is exactly with the left-wing progressive do.  They never speak of Equal Justice Under the Law.  They pervert the concept into "Social Justice", "Environmental Justice", "Economic Justice", etc.

This is simply a way of trying to sound as if there is "justice", but "justice" that is somehow "fair" -- "fair", of course, as it is defined at the moment by the Government and by those in the ruling class.  Justice becomes relative.  Justice becomes evolutionary.  Justice is to serve the needs of the collective.  Justice becomes situational, as do ethics.  (For example, Holder says the definition of lying to Congress "has to do with your state of mind, and whether or not you had the requisite intent to come up with something that can be considered perjury or a lie."  What?!  See!  Relative, situational, morphing "justice" to suit his own goals -- that's what Holder and Obama desire.

And Holder's perverse Department of Justice is still suing Arizona over SB-1070.  Paul Brodict called attention to the video below in an email that says:  "Watch, and let this sink in! The person in this video is a professor (PhD) at Yavapai College in Prescott , Arizona.  He puts a different spin on what Obama is doing to Arizona must be why he's rated highly by his students - 3.8 on a 4.0 scale.   This may be the best video produced on the illegal alien problems that are being experienced. (The video) is short and makes a lot of sense....  We need to get the word out."

Their actions are driving the illegal alien population here since we continue our lax enforcement and acceptance of "sanctuary city" policies by numerous municipalities.  This trend will only get worse and shows a complete disregard for our State laws, and a disrespect for our citizens, by illegal aliens in NC.  NCFIRE calls upon our Legislators in Raleigh, to enact "Arizona" type immigration laws as soon as possible.  We must get ahead of this problem before any more of our citizens fall victim to the illegal alien crime wave that is sweeping our state.
